Essentials Fitness agrees to furnish services to you as a customer, subject to the following Terms of Service.

Service Rates

You as a customer acknowledge that the nature of the services furnished, and the initial rates and charges have been communicated to you. You are aware that Essentials Fitness may change the specified rates and charges in the future provided a 30-day notice is given. The current rates and charges communicated are based on the current cost of providing services for Essentials Fitness, which these costs could change in the future.

Secure Payments

Essentials Fitness currently uses PayPal to process payments for its services, with all credit card information secured and stored by PayPal, and Essentials Fitness has no access to any credit card information. Therefore, you agree that Essentials Fitness will not and can not be liable for any credit card security breaches.

Refunds & Cancelations

Services at Essentials Fitness are sold based on a term of 30 Days, 3 Months, 6 Months, or 12 Months, with services auto renewing at the end of the term. Your only obligation is for the term you are currently signed up for, and while services can be canceled at any time, there will be no refund for any partial amounts. In addition, all payments to Essentials Fitness are non-refundable.

Intellectual ownership

All the content on the Essentials Fitness website (illustrations, texts, names, brand names, images and videos) are the property of Essentials Fitness and are protected by US Copyright. Any use of Essentials Fitness content without the express written consent of Essentials Fitness may result in legal action.

Website Use & Availability

Essentials Fitness works hard to ensure the Website is always up and available, but we can not guarantee that the website will not have downtime for any reason. We reserve the right to close the website for short periods of time for general maintenance, but will attempt to keep this to a minimum. We will not be liable if for any reason all or any part of the website is unavailable at any time, for any length of time.

The website requires you to input a password to access subscription services. It is your responsibility to keep your login information secure, and in the event that your password in compromised it is your duty to inform Essentials Fitness immediately. You further agree that if your password is compromised you will be liable for any damages that may occur as a direct result of your failure to keep your password safe.

We do not guarantee that the website or any content provided on the website is error free. We manage your personal data according to our Privacy Policy.

Liability of Essentials Fitness

You as a customer of fitness and nutrition services acknowledge that the services provided by Essentials Fitness are of such a nature that injury, illness or even death can caused by many reasons other than the negligence of Essentials Fitness and that the resulting damages are difficult to ascertain.

Therefore, you agree that Essentials Fitness, its owners, and employees shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the Essentials Fitness. You further acknowledge that Essentials Fitness's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by customer for services during the period damages occurred. In no event shall Essentials Fitness be liable for any special or consequential damages, loss, or injury.

Jurisdiction

You as a customer acknowledge and agree that all disputes regarding Essentials Fitness shall be resolved by litigation in the courts of the State of Texas.

Waiver and Severability

Any failure of Essentials Fitness to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Essentials Fitness, and governs your use of our services, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

Refusal of Service

Essentials Fitness reserves the right to refuse, cancel or suspend services to any client for any reason at its sole discretion.

REVISIONS TO TERMS OF SERIVCE

Essentials Fitness reserves the right to revise, amend, or modify this Terms of Service and our other policies and agreements at any time and in any manner with or without notice.
